ESMA发布有关清算、交易义务的澄清

10月31日，欧盟金融监管机构承认:如果某些集团和某些非金融交易对手方(NFCs+) 在12月21日之前不履行清算义务，它们将面临困难。就目前而言，与第三国集团实体达成的某些集团内部交易的埃米尔清算义务被取消，以及4类交易对手方在12月21日到期的利率衍生品类别(以受清算义务约束的G4货币计价)到期。
欧盟监管机构在其声明中表示:“ESMA预计，主管部门不会优先对集团实体采取监管行动，这些实体从集团内部交易在2018年12月21日及之后满足某些条件的减损中获益。”
Esma issues clarification on clearing, trading obligation
The European Securities and Markets Authority (Esma) has advised national competent authorities to not to focus supervisory efforts towards certain firms that may fall under the clearing obligation before an extension of their exemption is approved.
On October 31 the EU financial watchdog acknowledged the difficulties that certain groups as well as certain non-financial counterparties above the clearing threshold (NFCs+) would face should their derogation from the clearing obligation not be extended by December 21.
As it stands the derogration from the Emir clearing obligation for certain intragroup transactions concluded with a third country group entity, and the phase-in for counterparties in category 4, broadly speaking NFCs+, expires on December 21 for the interest rate derivative classes denominated in the G4 currencies subject to the clearing obligation.
In its statement the EU regulator said: "Esma expects competent authorities to not prioritise their supervisory actions towards group entities that benefit from the derogation for intragroup transactions meeting certain conditions on and after 21 December 2018."
